Terms and Conditions - Acme Blinds & Shutters Ltd

1. Definitions

“Company”, “we”, “us” refers to Acme Blinds & Shutters Ltd. “Customer”, “you” refers to the person or entity purchasing goods/services. “Goods” means window blinds, shutters, curtains, awnings and related products. “Services” includes consultation, measuring, delivery, and installation. “Bespoke products” means products manufactured specifically to a customer’s individual measurements, specifications, colour selections and requirements.

2. General

These Terms and Conditions apply to all purchases made through our showroom and any related home selection services. By placing an order in-store, by phone, or following a showroom or home selection consultation, you agree to these terms.

3. Showroom Display and Samples

3.1 All products displayed in the showroom or by our home selection representatives are samples only. 3.2 Colours, fabrics, and finishes may vary slightly from the final product due to manufacturing differences and lighting conditions. 3.3 Customers are responsible for confirming their final selections before placing an order.

4. Quotations and Orders

4.1 Written quotations are valid for 30 days unless otherwise stated. 4.2 Orders are confirmed once a deposit is received and an order confirmation is issued. 4.3 It is the Customer’s responsibility to review all details (measurements, product type, colour, controls) before confirming the order. 4.4 Orders for made-to-measure Goods cannot be changed once placed unless specifically agreed with the company.

5. Pricing and Payment

5.1 All prices are in Euro (€) and include VAT at the applicable rate unless otherwise stated. 5.2 A non-refundable deposit (50% of order value) is required when placing an order. 5.3 The balance must be paid prior to or on the day of installation/collection. 5.4 The Company reserves the right to withhold delivery or installation until full payment is received.

6. Measuring

6.1 If the Customer provides their own measurements, the Company accepts no responsibility for errors. 6.2 Where the Company provides a measuring service, reasonable care will be taken to ensure accuracy. In the event of the company making an error in either the manufacturing or measuring process it reserves
the right to remove the blinds from the customer premises in order to perform remedial works at the company’s premises. 6.3 Any subsequent changes requested after measurement may incur additional charges.

7. Delivery, Collection, and Installation

7.1 Estimated timelines are provided as guidance only and are not guaranteed. Actual delivery or installation dates may vary due to factors including: Manufacturing complexities, Availability of materials, Shipping delays, Installation availability, Weather conditions, Customer access issues. 7.2 Customers opting for collection will be notified when Goods are ready and must collect within a reasonable timeframe. 7.3 The Customer must ensure clear and safe access for delivery and installation. 7.4 Additional charges may apply where access is restricted or special equipment is required. 7.5 Installation appointments must be attended; missed appointments may incur a call-out fee.

8. Cancellation and Returns

8.1 Made-to-measure Goods are bespoke and cannot be cancelled, returned, or refunded once production has commenced. 8.2 Standard items purchased in the showroom may be returned within 14 days if unused and in original packaging. 8.3 Deposits for bespoke Goods are non-refundable. 8.4 These terms do not affect your statutory rights under Irish consumer law.

9. Warranty and Aftercare

9.1 Goods are supplied with a 12-month warranty against manufacturing defects. 9.2 This warranty excludes: Normal wear and tear, Misuse, neglect, accidental damage, or third-party installation. 9.3 Care instructions must be followed to maintain warranty validity.

10. Liability

10.1 The Company shall not be liable for indirect or consequential losses. 10.2 Liability is limited to the total value of the order. 10.3 Nothing in these Terms limits your rights under Irish consumer protection legislation.

11. Title and Risk

11.1 Ownership remains with the Company until full payment is received. 11.2 Risk passes upon delivery, collection, or installation.

12. Force Majeure

The Company is not responsible for delays or failure to perform due to events beyond its reasonable control, including supplier delays, transport issues, or extreme weather.

13. Data Protection

Customer information will be processed in accordance with applicable data protection laws, including GDPR, and used only for order processing and related communication.

14. Governing Law

These Terms and Conditions are governed by the laws of Ireland. Any disputes shall be subject to the jurisdiction of the Irish courts.

15. Amendments

The Company reserves the right to update these Terms and Conditions. The version applicable at the time of order will apply.
